What happens if you do not have an Advance Directive in Louisiana and are unable to speak for yourself

The decisionmaker is decided by order of priority:

1. A spouse, if not judicially separated,
2. An adult child
3. A parent
4. A sibling
5. Other ascendants or descendants

If there is more than one person in a class, the declaration shall; be made by the majority, after good faith efforts to secure participation by all members of the class

LA Rev State 1159.4 provides for surrogate decision-making for surgical or medical treatment generally, with the same order of priority.

Note that in many states, there are separate requirements related to minors, specific types of treatment (such as mental healthcare or medical research), or for pregnant women. These more specific provisions are beyond the scope of this information. Some states will also allow for an oral designation of an agent.
